These Terms and Conditions (“Terms”) govern access to and use of the Onboard Space Platform (the “Platform”), including the website, services, and content made available through it.

Onboard Space is accessible through the website located at www.onboardspace.com and operates as an online platform. By using the Onboard Space website, you accept these Terms and Conditions.

By accessing or using thewww.onboardspace.comwebsite, creating an account, or posting content, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with these Terms, you must not use the Platform.

About the Platform

Onboard Space is an online platform that allows users to advertise and browse crew positions, boats for sale, and marine-related equipment.

Onboard Space is designed to bring together Boat Owners, or their Representatives, who are looking for crew, and individuals seeking opportunities on board, whether that means finding a boat, securing a crew position, or exploring roles within the marine industry.

The Platform enables Members to post and browse adverts and to connect and communicate with one another in order to find a suitable boat, position, or crew member. It also allows Boat Owners who wish to sell their boats to connect with individuals interested in purchasing one.

Users may browse advertisements without registering on the Platform. However, users must create an account and become a Member in order to apply to adverts or contact Advertisers.

On the Boats for Sale page, sellers (“Advertisers”) may publish advertisements for boats or related products, and buyers (“Interested Parties”) may browse these listings and contact sellers directly.

Onboard Space provides only the technical infrastructure that enables their interactions.

Onboard Space does not own, sell, or purchase any boats listed on the Platform and does not act as a broker, intermediary, or agent in any transaction between users. All transactions are conducted directly between Advertisers and Interested Parties.

The trading name “Onboard Space", the internet address "Onboardspace.com" including its design, software, the Onboard Space logo, text and graphics are the intellectual property of Hortensia Chapela Nunez and may not be used, copied or reproduced in any form without the prior written permission of the owner.

Users may access and use the Platform solely for personal or commercial purposes permitted under these Terms.

Users may not copy, reproduce, distribute, or modify any Platform content without prior written permission.

By using the website and accepting these Terms and Conditions, you acknowledge and agree that Onboard Space is not a party to any agreement, contract or contractual relationship of any nature entered into between Members of its website.

Onboard Space does not guarantee that the website will be free from faults or uninterrupted and does not accept liability for any errors or omissions.

The Platform and all services provided through it are offered on an “as is” and “as available” basis.

Onboard Space does not guarantee that the Platform will always be available or uninterrupted, that listings published by users are accurate or complete, or that transactions between users will be successful.

Users are responsible for verifying all relevant information before entering into any transaction.

By registering on the website and logging into your account, you acknowledge that you have read and accepted these Terms and Conditions.

Onboard Space reserve the right to modify these Terms and Conditions at any time. The modified Terms and Conditions will be binding on all users from the moment they are published on the website. By continuing to use the service after such changes are posted, you accept the Terms and Conditions as modified.

We reserve the right to deny access to this website, or to any service provided through it, to anyone who violates these Terms or who, in our judgment, interferes with the ability of others to use the website or infringes the rights of others.

Onboard Space has no control over the behaviour of its Members or the users of the website. It does not own, operate, supply or manage the vessels that are the subject of advertisements, and it does not offer any trips through the website. Therefore, you acknowledge and accept that Onboard Space does not control the validity, truthfulness or legality of the advertisements, onboard spaces or trips offered by users. Onboard Space does not provide any transport services and does not act in the capacity of a charter company. The role of Onboard Space is limited to facilitating access to the Platform.

Also, Onboard Space does not inspect, survey, board, investigate, verify, or otherwise examine any vessels listed or offered for sale on the platform. Accordingly, Onboard Space makes no representations or warranties, express or implied, regarding the condition, state, history, seaworthiness, legality, or suitability of any vessel advertised on the platform.

All information relating to vessels is provided solely by the respective sellers and has not been independently verified by Onboard Space. Users acknowledge and agree that Onboard Space has no knowledge of the actual condition or status of any vessel and shall not provide, and shall not be deemed to have provided, any advice, opinion, recommendation, or assurance regarding any vessel listed on the platform.

Prospective buyers are solely responsible for conducting their own due diligence, inspections, and surveys prior to entering into any transaction.

If you purchase services or advertising packages on the Platform, additional terms may apply.

The Platform may also offer automated tools such as translation of listings. These translations are provided for convenience and may not always be accurate.

Onboard Space reserves the right to modify the design, structure, or functionality of the Platform at any time without prior notice.

DEFINITIONS

In these Terms and Conditions, "we", “our” and "us" means Onboard Space which is a trading name of self-employed business Hortensia Chapela Nunez, registered in Spain under number 78733603A, whose registered office is at La Junquera 7, Moaña 36955, Pontevedra, Spain, Phone: +34 653 05 05 05, Email: info@onboardspace.com

Sailing Opportunity means an advertisement posted on the website by a Boat Owner or their Representative (such as a captain, skipper, or agent) regarding a sailing voyage or a job opportunity onboard a vessel or onshore.

Account means the account that must be created to become a Member and access certain services offered by Onboard Space.

Member means any individual who has created an account on the website.

Boat Owner means a Member who uses the website to offer a place or position (by means of an advertisement) onboard a boat or in an onshore role, at a defined time, to another individual. A Boat Owner or their Representative may also use the website to search for crew. Boat Wwners may also use the Platform to place adverts offering their boats for sale and connect with individuals interested in buying them. At the same time, they may browse and search for boats available for purchase if they are looking to buy a boat themselves.

Crewmember means a Member who is seeking a place or position onboard a boat, or an onshore role, through an advertisement placed on the website by a Boat Owner or their Representative. Crewmembers may also browse and search for boats listed for sale on the Platform if they are interested in purchasing one.

Representative means a person authorised by the Boat Owner to place an advert, search for crew, and accept applications on the Boat Owner’s behalf.

Advertiser means an individual or entity who offers, through the platform, a boat or boats for sale, or marine-related products.

Our Fee means, for a given trip or specific job opportunity, the amount charged by Onboard Space to the Boat Owner and/or Crewmember after they have both agreed to accept the advert or application. In addition, a fee is charged for the opportunity to advertise or list a vessel for sale through the platform. Onboard Space uses ‘credits’ as its payment method.

Accepting means the action by which both the Boat Owner and the Crewmember agree to each other’s offer or application and pay the applicable fees. Once the fees have been received Onboard Space will provide the Members with each other’s contact details.

Advert means a sailing opportunity, job opportunity, or other listing offered by a Member on the Onboard Space Platform.

Space means a place available onboard a boat for a sailing trip, course, or job opportunity, or an onshore position or course.

Services means all services provided by Onboard Space through the Platform.

Website means the website accessible at the addresswww.OnboardSpace.com.

Platform means the system created and operated by Onboard Space that facilitates, among other services, the exchange of information between Boat Owners and Crew.

HOW IT WORKS

An advert is posted on the Onboard Space Platform by a Boat Owner (or their Representative) who is looking for crew.

Individuals looking to join a boat (Crewmembers) for a sailing trip, course, or other marine activities can search the Platform to find adverts that match their interest.

The Boat Owner and the Crewmember may interact with each other via email and ask any relevant questions before accepting to travel together or deciding whether to proceed.

When both the Boat Owner and the Crewmember click the ‘Accept’ button on the advert page and complete the required payment, Onboard Space will then email them each of them the other party’s personal contact details.

Boats For Sale:

Advertisers may publish listings for boats or marine equipment on the Platform.

By creating a listing, the Advertiser confirms that the boat or product description is accurate, complete and truthful, is legally available for sale, the Advertiser has full legal right and authority to sell the boat or product, and images used in the listing accurately and fairly represent the product being offered.

Listings must be entered in the appropriate category and must not contain misleading or false information.

Advertisers must remove listings promptly if the vessel or product for sale is no longer available.

Onboard Space reserves the right to remove listings that violate these Terms or any applicable law.

REGISTRATION AND MEMBERSHIP

Certain features of the Platform require the creation of a user account.

To register on the website, users must have read and accepted these Terms and Conditions and the Privacy Policy.

Users agree to provide accurate and complete registration information and are responsible for all activities that are carried out through their account.

Onboard Space reserve the right to refuse, suspend, or terminate Members’ profiles at its sole discretion.

Users must immediately notify Onboard Space if they suspect any unauthorised access to or misuse of their account.

Onboard Space reserves the right to suspend or terminate accounts that violate these Terms or applicable law.

Membership is open to individuals aged 18 years or older, subject to acceptance. By accessing, registering and using the Platform, you represent and warrant that you are aged 18 or older. Members under the age of 18 must provide parental or guardian consent.

Onboard Space membership is available worldwide through the Onboard Space website. Boat Owner and Crew Membership are free of charge and can be obtained by completing an online registration form.

To create an account, the Member must complete all mandatory fields on the online registration form.

When creating a Member account, the Member agrees to provide accurate and truthful information and to update it through their profile, as necessary. The Member also agrees not to register under, or attempt to access the service using, the name of another person. Onboard Space reserved the right to reject or terminate any username that it deems offensive in its sole judgment.

Upon registering with us, Members are issued a username and password, which must be used to access certain restricted parts of the website. The username and password are the methods used to identify our Members. It is the Member’s responsibility to keep their password secure and to change it regularly, including whenever they suspect that others may have seen it.

The username and password are personal to each registered user and are not transferable to third parties. Members are responsible and liable for all information posted on the Platform and for any actions of any person logging into the Platform using their username and password (including, without limitation, any adverts posted via their account). Members should notify us immediately if they suspect unauthorised use of their account.

The Platform provides its Members with a personal profile, which includes ratings and reviews from other Members, helping users make more informed decision.

Members must promptly update any changes to their personal circumstances, such as changes of address or contact details.

Members (Boat Owners, Crewmembers and Advertisers) act under their sole and full responsibility.

Onboard Space reserves the right to remove Member’s profiles and adverts from the website.

Information on boats, Boat Owners, and Crewmembers received from Onboard Space may not be disclosed with any other person under any circumstances. Any breach of these requirements may result in the immediate termination of membership.

Members acknowledge and accept that any information that has passed the verification procedure on the Platform cannot guarantee the truthfulness, reliability, or validity of such information. Members accept that it is their responsibility to verify the accuracy of such information before using it. The views expressed by other users on our website do not necessarily reflect the views or values of Onboard Space.

Boat Owners have the option to search for crew and invite them to apply for their advertised opportunities by sending a message via the Onboard Space Platform. Each invitation sent incurs a cost, which must be fulfilled using the Platform’s credits payment method.

Crewmembers will receive an email each time a Boat Owner sends them an invitation. Only one invitation per advert may be sent to the same Crewmember. If Crewmembers prefer not to receive emails or included in searches, they can disable such notifications via their dashboard by modifying their privacy settings.

By registering as Member, you authorise Onboard Space to share your personal details with other registered Members, for example, when an advert has been accepted. If you do not wish for your details shared with other Members, you must not use the website. Please refer to our Privacy Policy for full details.

Boat Owner:

Registration of an account and posting an advert grants each Boat Owner or their Representative the right to have their advert shared with other Onboard Space Members.

Onboard Space reserves the right to refuse, suspend or cancel a Boat Owner’s registration or advert at any time, at its sole discretion.

Boat Owners are required to promptly notify Onboard Space by updating their profile in the event of any changes to personal circumstances, such as change of address, contact details or vessel information.

Boat Owners should update their advert opportunities as soon as possible when an advertised trip is full or withdrawn for any reason.

Boat Owners can edit adverts and send, for a fee, an automatic message to Members to notify them of these changes.

Boat Owners are always reminded of their legal responsibility for the safety of their vessel and crew, in accordance with International Maritime Law.

Onboard Space recommends that each Boat Owner hold adequate insurance for their vessel and crew.

Information provided and logged by Crewmembers during registration is their responsibility; therefore, Boat Owners must satisfy themselves as to the suitability and competence of any crew they engage.

Boat Owners agree to wait for the crew at the agreed meeting place and time. In the case of any delays (for example due to severe weather), Boat Owners must inform the crew as soon as possible.

Boat Owners must ensure that Crewmembers can contact them using the phone number registered on their profile.

Crewmember:

Information provided and logged by the Boat Owner during registration means that all Members must satisfy themselves as to the appropriateness, suitability, and safety of any boat on which they propose to crew, as well as the competence of the Captain and other crew members.

Crewmembers agree to adopt appropriate behaviour during the trip and to respect the Boat Owner, other Crewmembers, the vessel, and its cleanliness.

Crewmembers agree to wait for the Boat Owner at the agreed meeting place and time. In the case of any delays, they must inform the Boat Owner as soon as possible.

Crewmembers agree to provide Onboard Space, or any Member who requests it, with their identity card details or any documents, such as certificates, confirming their identity and qualifications.

Crewmembers must not carry any item, goods, substance, or animal during a trip that could compromise the safety of the trip, without the prior permission of the Boat Owner.

When visiting another country, Crewmembers agree to hold and make available to the Boat Owner, and to any authority that requests it, any documents providing proof of identity and the right to travel to that country.

Crewmembers must ensure that Boat Owners can contact them using the phone number registered on their profile.

ACCESSIBILITY

Onboard Space will endeavour to maintain uninterrupted access to the website. Nevertheless, access to the website may be restricted, suspended or terminated at any time without notice due to technical maintenance, migration, update operations, or outages or constraints related to the operation of the website. We will not be liable to you if, for any reason, the website is unavailable at any time or for any period. Furthermore, Onboard Space reserves the right, at its sole discretion, to modify or suspend all or part of access to the website or its functionalities, temporarily or permanently.

We do not monitor, verify, or endorse the accuracy of information hosted on the website or submitted by third parties. Members should be aware that such information may be inaccurate, incomplete, or out of date.

We do not warrant that the website is free from viruses or anything else that may have a harmful effect on your technology. We will not be liable for any loss or damage caused by a virus or other technologically harmful material that may infect your computer equipment, programs, data, or other proprietary material due to your use of the website, your downloading of any content from it, or from any website linked to it.

We have the right to disable any username or password at any time if, in our reasonable opinion, someone has failed to comply with any of the provisions of these Terms and Conditions.

We reserve the right (without limiting our right to seek other remedies) to remove offending material placed on the website that we consider to constitute a misuse of the website or that is otherwise harmful to other users. We may also suspend or permanently refuse access to the website for anyone whom we suspect has breached or is likely to breach these Terms and Conditions.

Users may submit or upload content to the Platform, including listings, images, descriptions, comments, and messages (“User Content”).

By submitting User Content, users confirm that they own the rights to such content or have the necessary authorization to use it.

Users grant Onboard Space a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and promote User Content for the purpose of operating and marketing the Platform.

Users remain responsible for the legality and accuracy of their content.

We will not be responsible or liable to any third party for the content or accuracy of any content posted on the website by our Members or users.

We provide tools that enable our Members to search for sailing trips and crew. We do not supervise these trips and are not involved in any way with the actions of any individuals. As a result, we have no control over the identity of the individuals present on these trips and request that our Members exercise caution and good judgment when participating in such trips.

Members can hide their profile at any time so that other Members cannot access their account. Boat Owners can hide their profile only when no adverts are active on their account.

ADVERT

To post an advert, the Member must own a boat or be the Boat Representative (with the permission of the Boat Owner). The boat intended for the trip must be well-maintained, equipped with beds/berths if necessary, and hold appropriate insurance for the duration of the trip. Boat Owners must not offer more spaces than are available onboard.

When posting an advert, the Boat Owner may indicate important sailing information, such as the marinas they intend to visit for refuelling and victualling.

Boat Owners acknowledge that they are solely responsible for the content of the adverts they post on the Platform. Consequently, Members represent and warrant the accuracy and truthfulness of all information contained in their advert and undertake to fulfil the trip under the conditions described therein.

Provided the advert complies with these Terms and Conditions, it will be published on the website and visible to Members, as well as to all visitors conducting a search on the website, including non-Members.

Adverts may be shared on social media platforms to inform Onboard Space Members about new sailing opportunities.

Onboard Space reserves the right, at its sole discretion and without notice, to accept, modify, reject, or remove any advert that it considers may mislead, confuse, upset, or cause offense to any party, or that it considers damaging to its image, the Platform, or its services.

Adverts will expire and be removed from the website (opportunities page) on the trip’s start date or as soon as they have been confirmed (accepted) by Members and payment has been received from both the Member posting the advert and the Crewmember applying for it.

Below are examples of content that is not allowed and must be avoided when posting an advert opportunity:

  • Inappropriate advert titles, descriptions, or imagery.
  • Adverts that display shocking content or promote hatred, intolerance, discrimination, or violence.
  • Content that harasses, intimidates, or bullies individuals or groups, or seeks to exploit others.
  • Use of images intended to shock, scare, or cause a dramatic negative response in viewers.
  • Sexually suggestive or explicit images.
  • Language targeting specific people or demographics.
  • Obscene, violent, or rude language.
  • Adverts that promote hatred, intolerance, discrimination, or violence based on race, ethnic origin, religion, disability, age, nationality, veteran status, sexual orientation, gender, gender identity, or other characteristics associated with systemic discrimination or marginalization.

If a user finds an advert on the Onboard Space website that they believe is abusive, fake, or fraudulent, they may report it by clicking the "Report advert" button on the advert. Onboard Space will investigate and take the necessary action.

Adverts will be deleted and removed from the Onboard Space system one year after the trip start date.

PROHIBITED USE

Users agree not to use the Platform for unlawful or harmful purposes.

Prohibited activities include, but are not limited to:

  • Publishing false or misleading adverts.
  • Violating intellectual property rights.
  • Uploading malicious software, scripts, or harmful code.
  • Sending unsolicited advertisements or spam.
  • Harassing, threatening, or abusing other users.
  • Collecting personal data from other users without authorization.

Onboard Space reserves the right to remove content or suspend users who violate these rules.

RATINGS AND REVIEWS

Onboard Space encourages Members who have participated in a trip to leave a review after the trip start date.

Members can use our integrated “star” system to rate their experiences and leave a brief comment in their own words. To leave a review, Members can click the relevant “Rate” button that appears on their Applications and Requests page for trips that have already occurred and follow the instructions.

Reviews and ratings are visible and published on the Platform immediately after Members submit them. Reviews can be viewed on the respective profiles.

Published ratings and reviews cannot be edited or deleted by Members to maintain the integrity of the ratings system.

Members acknowledge and accept that Onboard Space reserves the right not to publish or to remove any review, question, comment, or response if it deems the content in breach of these Terms and Conditions.

To respect Member privacy, boat names, personal data, contact details, email addresses, advertising, or web links must not be included in reviews. Personal or intimate details about individuals must also not be disclosed.

Members providing false or fake ratings and reviews may have their membership suspended or terminated.

Onboard Space reserves the right (but has no obligation) to monitor, remove, or edit Member reviews at its sole discretion, including if content violates this agreement. Members acknowledge that Onboard Space may not regularly review submitted reviews. Members also acknowledge and agree that any reviews they submit are non-confidential and non-proprietary. Onboard Space takes no responsibility and assumes no liability for any reviews submitted by Members or third parties.

When leaving a review, Members are encouraged to describe the facts and provide reasons, particularly in the case of negative reviews.

Onboard Space reserves the right to suspend a Member’s account, limit access to the services, or terminate membership if a Member has received at least five reviews and the average review is less than or equal to two stars.

CANCELLATION

Only trips or job opportunities that have been applied for, confirmed, and paid for are subject to this cancellation policy.

Onboard Space does not offer any guarantee of any nature in the event of a cancellation of an advert by a Member, for any reason.

If the Boat Owner cancels a trip before the planned departure date specified in the advert, or fails to arrive at the meeting point, Onboard Space retains the Boat Owner’s fee, and the Crewmember is refunded the full amount paid. The Crewmember must notify Onboard Space within 30 days of the departure date in order to receive a refund.

If the Crewmember cancels a trip before the planned departure date specified in the advert, or fails to arrive at the meeting point, Onboard Space retains the Crewmember’s fee, and the Boat Owner is refunded the full amount paid. The Boat Owner must notify Onboard Space within 30 days of the departure date in order to receive a refund.

WITHDRAWAL

Members have no right of withdrawal from the time of trip confirmation and once the contract between the Member and Onboard Space (consisting of Onboard Space providing a Member with another Member’s contact details) has been fully executed.

TERMINATION OF ACCOUNT

You may terminate your contractual relationship with Onboard Space at any time.

To change your privacy settings, click on the Profile icon. Scroll to the bottom of the page to find “Privacy Options,” where you can check or uncheck options such as “Hide my profile” (to make your account inactive), and click “Save Changes” to apply. Additionally, at the bottom of each email received from Onboard Space, you have an automated option to change your privacy settings.

If you wish to delete your account, contact us at info@onboardspace.com. Please note that we may retain certain information as required by law or for legitimate business purposes, as necessary to fulfil the purposes identified in the Privacy Policy. We may also retain archived copies of information (including location information) about you for a specified period.

RULES

Members must not open more than one account on the Platform, impersonate any person or entity, or falsely state or otherwise misrepresent their affiliation with any person or entity.

Upon creation of an account, Members must not provide Onboard Space or other Members with false, misleading, malicious, or fraudulent information. Inappropriate messages are prohibited.

Members are responsible for ensuring that no data is uploaded or submitted that is illegal, unlawful, harmful, threatening, untrue, defamatory, obscene, abusive, or otherwise in breach of any applicable laws or the rights of third parties.

Members must not include telephone numbers, email addresses, or full names in email messages or profile content.

Members must not speak, behave, or post content on the Platform that is defamatory, injurious, obscene, pornographic, vulgar, offensive, aggressive, violent, threatening, harassing, racist, xenophobic, or sexually suggestive; content that incites violence, discrimination, or hatred; content that encourages illegal activities or the use of illegal substances; or any content generally contrary to the purposes of the Platform or that may infringe the rights of Onboard Space or third parties, or violate accepted standards of morality.

Members must not obtain, or attempt to obtain, any information through means not intentionally made available on the Platform. Bypassing the application system by sending another Member contact details to circumvent the Platform and avoid paying fees is prohibited.

To report a user for fake or fraudulent activity, misleading information, abuse, or violation of Onboard Space Terms of Use, Members may visit the user’s profile and click the “Report Member” button. Onboard Space will investigate and take appropriate action.

Submitting a report does not automatically result in suspension of the reported Member or advert; it triggers an investigation to determine the appropriate action. False reporting will not be tolerated. If a report is deemed false or suspicious, the reporting Member may be contacted. Onboard Space reserves the right to deactivate any user account if it determines that a Member is abusing the Platform.

As a Boat Owner:

You must comply with all laws, regulations, and codes applicable to sailing and hold a valid sailing license when required. You are responsible for ensuring that your insurance policy covers your advertised trip for its entire duration. The vessel must be well-maintained and properly insured.

You are responsible for the vessel and must behave appropriately and responsibly during the trip. You must not take any unnecessary risks while sailing and must not consume any substance that could impair your attention or ability to sail safely. You must not have any medical condition or contraindication that would prevent you from sailing.

You must wait for Members at the agreed meeting place and on the agreed date. Considering that weather conditions may affect plans, you must communicate with Crewmembers as soon as possible in the event of delays. If, for any reason, the start time of the trip changes, you are responsible for informing your Crew without delay.

You must not provide more spaces onboard than the number indicated in the Advert.

You may provide Onboard Space or any Member who requests it with your sailing license, vessel registration certificate, insurance certificate, medical certificate, or any other document demonstrating your capacity to operate the vessel as a Boat Owner or Representative.

You may not post an Advert for a vessel that you do not own or are not authorised to use.

You must not decline any application based on race, colour, ethnicity, national origin, religion, sexual orientation, marital status, disability, physical appearance, pregnancy, economic vulnerability, name, place of residence, health, political opinion, or age.

You must not reproduce, adapt, modify, distribute, publicly display, or disseminate the Platform, the services, or the content, except as authorised by Onboard Space.

You must not extract, or attempt to extract, a substantial portion of the data from the Platform.

FEES

Certain services offered on the Platform may require payment. The applicable prices will be displayed at the time of purchase.

Available payment methods may include PayPal, credit or debit card, bank transfer, or other authorised payment services.

Failure to pay the required fees may result in suspension of services, removal of listings, or restrictions on the user’s account.

Deleting a listing before the expiration of its advertising period does not automatically entitle the Advertiser to a refund.

Access to and registration on the Platform, as well as searching, viewing, and posting adverts, are free of charge.

Onboard Space will request payment of fees from both the Boat Owner and the Crewmember once opportunity has been accepted and confirmed by both Members. Payment of the applicable fees will provide the Members with access to each other’s contact details.

When a Member successfully pays for an advert opportunity through the Platform, a twelve-hour window is provided to the other Member involved in the same opportunity to complete their payment. If the second Member does not complete payment within this twelve-hour period, the payment window will expire, and the system will prevent that Member from applying for the same advert opportunity again.

Onboard Space provides Members with a credit system to make payments on the website. Credits are used in the same way as money to pay the fees required to access other Members’ contact details.

Credits can only be purchased through the Onboard Space website. Members may buy credits by paying with a credit card through the secure PayPal payment system. Onboard Space will issue an invoice for each credit or credit package purchased on the website. For this purpose, the Member must provide Onboard Space with all the necessary billing details.

Members may purchase a single credit at the price of €5 (five Euros) per credit or choose from various credit packages available on the Platform (for example, 10 credits for €50). All fees include IVA (VAT in Spain), where applicable.

Each Member may receive three starting credits free of charge when registering for the first time with Onboard Space.

You acknowledge and accept that Onboard Space may, at its sole discretion, update its fees at any time.

Credits are non-refundable, and all payments are final without the option of a refund.

If Onboard Space blocks an advert because it considers, at its sole discretion, that the advert infringes these Terms of Use, Onboard Space will not refund the credits used in relation to that advert.

Purchased credits and free starting credits are not redeemable for cash and are not transferable. Credits are associated with the email account used when purchasing them. Credits are not transferable between accounts (for example, from one email address to another), even if both accounts belong to the same person.

Credits do not expire while you remain a registered Member on the Onboard Space Platform. However, there may be a limit on the number of unused credits held at any one time.

Posting an advert to sell a boat on the Platform costs one credit for every 30 days that the advert remains active. If the Member wishes to continue advertising after this period, an additional credit must be paid for each subsequent 30-day period. One credit is equivalent to €5.

REFUNDS

Onboard Space is unable to provide refunds for any accepted positions already paid for by both Members involved in the advert application. For more details regarding refunds, please refer to the Cancellation Policy.

LINKS AND ADVERTISING

The Platform may contain links to external websites or services operated by third parties.

These links are for convenience only. Onboard Space does not control and is not responsible for the content, policies, or practices of third-party websites.

Access to such websites is at the user’s own risk.

A link to another website does not constitute our endorsement of that website or of any product, service, or other material offered on that site.

We are not responsible for the performance of goods or services provided by advertisers or third parties linked from the Platform.

You may link to this website providing that you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

COMPLAINTS

Users may submit complaints relating to the Platform or our services if necessary.

Before initiating any formal proceedings, you agree to notify Onboard Space in writing of any dispute to attempt to reach an amicable resolution.

SECURITY AND SAFETY

Onboard Space cannot guarantee the accuracy of the information provided by its Members on the website and cannot be held liable for the actual occurrence of a trip where erroneous information has been communicated by the Boat Owner in the advert or by any other means regarding the trip and its terms.

Messages exchanged between Members are intended to clarify the details of the advert in advance and may be moderated for safety purposes.

Boat Owner details and any other information provided by Onboard Space must not be shared with any other person under any circumstances. Any breach of this condition may result in the immediate termination of Onboard Space membership.

All Members are expected to act in a professional and respectful manner at all times and to report any illegal or suspicious activities to the relevant authorities in accordance with international maritime law and the laws of the country they are visiting at the time.

Onboard Space may, for the purposes of transparency, improving trust, or preventing or detecting fraud, implement systems to verify certain information provided in Members’ profiles.

We may disclose your identity or other relevant information to law enforcement authorities where we consider it necessary to do so.

No part of any information or document may be reproduced, stored in a retrieval system, or transmitted in any form or by any means, electronic, mechanical, photocopying, recording, or otherwise without the prior written permission of Onboard Space.

Onboard Space cannot be held liable for the cancellation or modification of a trip by a Member, or for the behaviour of its Members before, during, or after a trip.

There are risks associated with sailing, and Onboard Space cannot be held responsible for any accident, injury, loss, or damage, however caused, resulting from a trip arranged through the Onboard Space website.

Onboard Space recommends that Members obtain adequate personal accident, sickness, and life insurance cover.

We do not review or guarantee the accuracy of any content posted in our blogs or other areas available for public postings (for example, social media). These areas may contain information and opinions from a variety of individuals and organisations other than Onboard Space.

Any breach of the security of a username or password must be reported to us immediately.

DATA PROTECTION AND PRIVACY

The Platform may include messaging tools that allow users to communicate with each other.

Onboard Space does not monitor all communications but reserves the right to review communications when necessary to: Enforce these Terms. Investigate complaints or suspected violations. Comply with legal obligations. Protect the rights or safety of users or the Platform.

Users are responsible for the content of their communications.

Personal data collected through the Platform is processed in accordance with the Onboard Space Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR).

Although Onboard Space implements reasonable technical and organisational measures to protect user data, no system can guarantee complete security.

LEGAL

All information provided by Onboard Space is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce any materials available on this website without the prior written consent of the owner.

You may not distribute copies of materials found on this website in any form (including by email) without the prior written permission of the owner.

Onboard Space cannot accept responsibility for any accident, injury, loss, or damage resulting from an advert application or any trip undertaken through the Platform.

We reserve the right (but assume no obligation) to delete, move, or edit any postings that come to our attention and that we consider unacceptable or inappropriate, whether for legal or other reasons.

It is strictly prohibited for users to act in a malicious manner, including loading, posting, emailing, transmitting, or otherwise making available any content or material containing software viruses, computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or other equipment, or to cause a security breach of such software, hardware, or equipment.

Any attempt by a user to gain unauthorised access to the website, or to any account, computer system, or network connected to the website, by means such as hacking, password mining, or other illicit methods, may constitute a violation of criminal and/or civil laws. In the event of such attempts, Onboard Space reserves the right to fully seek remedies and damages permitted by law, including criminal prosecution.

Users may not use this website to obtain information for unlawful purposes such as defaming, abusing, threatening, stalking, or harassing others.

Because Onboard Space does not supervise or control trips or interactions between Members of the Platform and other persons or companies, it is not involved in any way with physical transportation to or from vessels or with the actions of individuals onboard, does not control PayPal, credit card companies, or other payment processors, and cannot guarantee the true identity, age, or nationality of users, you acknowledge that you assume all risks associated with using the Platform.

You therefore agree to release Onboard Space from any claims, demands, or damages (whether actual or consequential) of every kind and nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising now or in the future out of, or in any way connected with, the use of the Platform.

Limitation of Liability:

Under no circumstances shall Onboard Space, or its agents, be liable to you or any other person for damages arising from the use of this website or any service available through it, including, without limitation, consequential, special, incidental, indirect, or similar damages, even if Onboard Space has been advised of the possibility of such damages.

To the fullest extent permitted by law, Onboard Space shall not be liable for damages arising from:

  • Transactions between users
  • Inaccurate or misleading listings
  • Technical interruptions or service outages
  • Loss of data or business opportunities

In all cases, Onboard Space’s liability shall be limited to the maximum extent permitted by applicable law.

INDEMNIFICATION

Users agree to indemnify and hold Onboard Space harmless from any claims, damages, losses, liabilities, or expenses arising from their use of the Platform, their User Content or listings, any violation of these Terms, or any disputes with other users.

SUSPENSION OR TERMINATION

Onboard Space may suspend or terminate access to the Platform if a user violates these Terms, fails to pay required fees, or engages in unlawful or harmful activities. Other serious violations may result in immediate termination without prior notice.

GOVERNING LAW AND AUTHORITY

These Terms and any disputes arising from the use of the Platform shall be governed by the laws of Spain.

Unless otherwise required by mandatory consumer protection laws, any disputes shall be subject to the exclusive authority of the courts of Spain.

ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any additional agreements related to specific services, constitute the entire agreement between users and Onboard Space regarding the use of the Platform.

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

By accessing or using the Platform, creating an account, or posting content, you agree to comply with these Terms. If you do not agree with these Terms, you must not use the Platform.
